Terms & Conditions
These terms apply to centres engaging Ready Kids (Enrich Therapy Pty Ltd) for OT Support for Educators, and to anyone using the readykids.com.au website. Please read carefully before engaging our services or using the site.
Part A — Ready Kids OT Support for Educators
1. Responsibilities of Ready Kids OT
Ready Kids provides virtual and in-person services with due care, skill, and diligence. We commit to delivering coaching, mentoring, workshops, and assessments within reasonable timeframes. If a centre does not engage services within 12 months of purchase, those services are deemed completed and non-refundable.
We aim for continuity with the same therapist but may assign substitutes due to illness, leave, or training needs. Screening assessments are brief tools intended to provide a general snapshot and are not diagnostic. The program does not include one-on-one child intervention.
2. Responsibilities of the Childcare Centre
Centres must maintain timely communication and promptly notify Ready Kids of communicable illness outbreaks to prevent rescheduling conflicts. Centres should also alert Ready Kids to significant staffing changes, including turnover of key educators.
Centres are responsible for ensuring educator attendance, classroom access, data collection support, and distributing Ready Kids materials to staff. Centres handle all parent communications regarding scheduling and permissions.
3. Rescheduling and Cancellations
Ready Kids may reschedule due to illness or emergencies with advance notice. Administrative fees apply when centres request rescheduling due to avoidable scheduling changes. Unforeseen educator unavailability generally waives fees.
Centres must rebook sessions within a reasonable timeframe. If Ready Kids has commenced travel for an in-person session, it will proceed as scheduled. Projects with defined timeframes may have adjusted schedules.
4. Payments and Refunds
Quoted fees include travel and standard resources unless specified otherwise. All payments made to Ready Kids for services rendered under the OT Support for Educators program are non-refundable. Centres remain financially responsible even if government funding does not materialise.
5. Expiry of Unused Services
Services purchased but not used within 12 months of purchase are forfeited and deemed as completed, with no entitlement to refund or credit.
6. Access to Online Resources and Community
Centres receive access to online courses, Q&A sessions, community platforms, and resource toolboxes for the calendar year in which the service was purchased. Access ceases on 31 December of that year.
Missed live sessions receive no credit or rescheduling. Group sessions are not private; participants acknowledge information shared during these sessions may be visible to others. Centres cannot share passwords, materials, or recordings with other organisations.
7. Confidentiality and Information Sharing
Ready Kids takes reasonable steps to maintain confidentiality and security of information through secure storage and restricted access. All intellectual property remains Ready Kids' sole property; centres receive a non-transferable licence for internal use only.
Ready Kids retains ownership of collected data, feedback, and materials for quality improvement, training, service development, and marketing. By participating, centres consent to receive service communications and newsletters, with opt-out options available.
8. Optional Programs and Services
Optional programs are governed by attached Schedules and form part of the agreement when selected.
9. Limitation of Liability
Ready Kids maintains professional indemnity and public liability insurance. We are not liable for indirect, incidental, special, or consequential damages. Centres indemnify Ready Kids from claims arising from non-compliance.
Strategies and recommendations are offered in an advisory capacity only. Centres are responsible for risk assessments and implementation decisions. Neither party is liable for failures due to events beyond reasonable control.
10. Dispute Resolution
Parties agree to resolve disputes through good faith informal discussions. If unresolved within 30 days, either party may pursue mediation before legal action.
11. Termination
Either party may terminate with 30 days' written notice. Centres remain liable for delivered or scheduled services during the notice period. Refunds for undelivered services remain at Ready Kids' discretion.
12. Governing Law
These terms are governed by Queensland, Australia law and subject to exclusive Queensland court jurisdiction.
13. Entire Agreement
These terms and applicable Schedules constitute the entire agreement. Ready Kids may update terms with email notification; continued engagement indicates acceptance.
Schedule A — ECT ProSupport
Cancellation Policy: Quarterly plans allow cancellation anytime with no fee. Yearly commitments incur exit fees calculated as the difference between yearly and quarterly rates. Exit fees are waived upon completing an exit interview. Cancellation requests via phone or email to info@readykids.com.au must arrive before the quarter's end.
Growth Credit: Credits are issued during active subscriptions and apply only to eligible services. Credits have no cash value and are non-transferable, and cannot address past invoices. Credits expire if subscriptions end.
Check-In Meetings: Included meetings must be used within their quarter; unused meetings are forfeited if not used within the agreed timeframe.
Schedule B — Bonus Programs
Ready Kids occasionally offers complimentary bonus programs at no additional cost. These are not guaranteed unless expressly confirmed in writing. Ready Kids may change, update, or withdraw Bonus Programs that haven't commenced or been accessed.
Part B — Website Terms of Use
Acceptance
By accessing the readykids.com.au websites (including members.readykids.com.au and any related mobile applications, the “Site”), you agree to be bound by these terms. If you do not agree, please discontinue use of the Site immediately.
The Site is intended for users aged 13 or older. Minors must have parental or guardian permission before using the Site.
Intellectual Property
Unless otherwise indicated, the Site and all source code, databases, software, designs, audio, video, text, photographs, graphics, trademarks, service marks, and logos are owned or licensed by Ready Kids and protected by copyright and trademark law. You are granted a limited, personal, non-commercial licence to view and print Site content. All other rights are reserved.
Acceptable Use
You agree that you will not:
- Use the Site for any illegal or unauthorised purpose, or in breach of any applicable law or regulation.
- Scrape, data-mine, or systematically retrieve content to create a collection, database, or directory without written permission.
- Decompile, reverse-engineer, or attempt to derive the source code of any part of the Site or our mobile applications.
- Upload viruses, malicious code, or other material designed to interfere with the Site or other users' enjoyment of it.
- Use the Site to advertise or sell goods or services without our written endorsement.
- Impersonate another user, harass, abuse, or harm any other person using the Site.
- Bypass, disable, or interfere with any security or access-control features of the Site.
User Contributions
Anything you submit through forms, comments, or other features (“Contributions”) may be treated as non-confidential. You represent that your Contributions do not infringe any third party's rights, are accurate, and comply with applicable law. By posting, you grant Ready Kids a non-exclusive, royalty-free, worldwide licence to host, display, and use those Contributions in connection with the Site and our services.
Third-Party Links and Content
The Site may contain links to third-party websites or content. We do not endorse, monitor, or accept responsibility for the accuracy or practices of those third parties. Any interaction with them is at your own risk and subject to their own terms.
Disclaimers and Liability
The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties and will not be liable for any indirect, consequential, or incidental damages arising from your use of the Site.
You agree to indemnify Ready Kids and its officers, employees, and agents from any claim or loss arising from your Contributions, your use of the Site, or your breach of these terms.
Termination and Modifications
We may suspend or terminate access to the Site at any time, without notice, for breach of these terms or any other reason. We may modify or discontinue any part of the Site at any time.
We may update these terms from time to time. The current version governs your use of the Site; continued use after updates indicates acceptance.
Governing Law
These website terms are governed by the laws of Queensland, Australia, and disputes are subject to the exclusive jurisdiction of the Queensland courts.
